Class Actions for Prisoners 

Class Actions are lawsuits wherein a group of people, such as people who have experienced incarceration, are represented collectively by a member or members of that group. We have included a list of Class Actions that people who are experiencing or who have previously experienced incarceration may qualify for.

All current and former inmates of correctional institutions as defined in the Ministry of Correctional Services Act, R.S.O. 1990, c. M.22 (the “Correctional Institutions”), between May 30, 2009 and November 27, 2017 who are or were remanded, except the Excluded Persons;All current and former inmates of the Correctional Institutions between May 30, 2009 and November 27, 2017 who are or were serving a sentence at a Correctional Institution or who have violated parole and are or were imprisoned at a Correctional Institution as a result, except the Excluded Persons; and,

Excluded Persons” are:
  • all inmates detained only in accordance with the Immigration and Refugee Protection Act, S.C. 2001, c.27; and,
all inmates of Elgin-Middlesex Detention Centre, the Ontario Correctional Institute and the St. Lawrence Valley Correctional and Treatment Centre (solely with respect to their incarceration at those Correctional Institutions).

Bail Delays
The proposed class includes all persons who were arrested and detained for a period of more than 24 hours prior to any meaningful bail hearing being available for the time period of January 1, 2000 to the present.

Immigration Detention 
The class includes all migrants detained by the Canada Border Services Agency and incarcerated in a provincial prison between December, 2003 and the present.

Inmates with a Serious Mental Illness
a) who were subjected to Administrative Segregation for any length of time at one of the Correctional Institutions between January 1, 2009 and the date of certification;

b) who were diagnosed by a medical doctor before or during their incarceration with at least one of the following disorders, as defined in the relevant Diagnostic and Statistics Manual of Mental Disorders (“DSM”): [...] and who suffered from their disorder, in a manner described in Appendix “A”, and,

c) who reported such diagnosis and suffering to the Defendant’s agents before or during their Administrative Segregation (the “SMI Inmates”);

II. Inmates in Prolonged Administrative Segregation
a) who were subjected to Administrative Segregation for 15 or more consecutive days (“Prolonged Administrative Segregation”) at one of the Correctional Institutions between January 1, 2009 and the date of certification (the “Prolonged Inmates”)

Administrative Segregation 
You are a class member if:
  • You stayed in administrative segregation in an Ontario Jail, except the St. Lawrence Valley Correctional and Treatment Centre;
  • For 15 days or longer; and
  • Between April 20, 2015 and August 18, 2021.
–OR–
You are a class member if:
  • You stayed in administrative segregation in an Ontario Jail, except the St. Lawrence Valley Correctional and Treatment Centre;
  • You were diagnosed by a medical doctor with an eligible mental health disorder before or during your incarceration; AND
  • You reported your diagnosis and suffering to Ontario’s agents or employees before or during your stay in administrative segregation.
Some exceptions apply

The Court decided that Class Members who stayed in Administrative Segregation, ONLY between January 1, 2009 and April 19, 2015, cannot make a claim unless they can prove that they could not make a claim before April 20, 2015.
